Terms of Service

Welcome to CyberKy. These Terms of Service ("Terms") govern your access to and use of the CyberKy website, platform, courses, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

3. Subscriptions and Payments

3.1 Subscription Plans

CyberKy offers various subscription plans that provide access to courses, mentorship, and platform features. The specific features included in each plan are described on our pricing page. We reserve the right to modify plan offerings, features, and pricing at any time.

3.2 Payment Processing

Payments are processed through our payment partner, Whop. By subscribing, you authorize Whop to charge your designated payment method for the subscription fees. You agree to Whop's terms of service as they relate to payment processing.

3.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless you cancel before the renewal date. You will be charged the then-current subscription rate at each renewal.

3.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you will retain access to the Service until the end of your current billing period. No partial refunds are provided for the remaining portion of a billing period.

Our refund policy is detailed on our Refund Policy page. Please review it carefully before making a purchase.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Share, distribute, or resell your account credentials or course materials to any third party.
  • Copy, reproduce, modify, or create derivative works from any course content, videos, materials, or other intellectual property.
  • Use automated tools, bots, or scripts to access or scrape the Service.
  • Circumvent, disable, or interfere with security features of the Service.
  • Upload or transmit viruses, malware, or other malicious code.
  • Harass, abuse, or harm other users, mentors, or CyberKy staff.
  • Use the Service for any illegal activity or to promote illegal activities.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Violate any applicable laws, regulations, or third-party rights.

5. Intellectual Property

5.1 CyberKy Content

All content on the Service—including but not limited to courses, videos, text, graphics, logos, images, software, and documentation—is the property of CyberKy or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the content solely for your personal, non-commercial educational purposes while your subscription is active.

5.2 Restrictions

You may not reproduce, distribute, publicly display, publicly perform, modify, translate, or create derivative works of any CyberKy content without our prior written consent. Any unauthorized use terminates the license granted herein and may subject you to legal action.

5.3 User Content

If you submit any content to the Service (e.g., forum posts, project submissions, feedback), you grant CyberKy a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display such content in connection with operating and improving the Service.

6. Third-Party Services

The Service may integrate with or contain links to third-party services (e.g., Whop for payments, Discord for community). Your use of such third-party services is subject to their respective terms and privacy policies. CyberKy is not responsible for the content, practices, or availability of third-party services.

7. Disclaimers

7.1 Educational Content

The Service provides cybersecurity education and training for informational and skill-building purposes. CyberKy does not guarantee any specific outcomes, including job placement, salary increases, certification pass rates, or career advancement. Your success depends on many factors, including your effort, background, and circumstances.

7.2 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CYBERKY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERKY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL CYBERKY'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO CYBERKY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless CyberKy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

11. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Kentucky, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Kentucky, and you consent to the personal jurisdiction of such courts.

13. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CyberKy regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
